陜西省人民政府辦公廳關于促進建筑業持續健康發展的實施意見

各(ge)設區市人民政府,省人民政府各(ge)工作部(bu)門、各(ge)直屬機構:

為(wei)貫徹(che)落實(shi)《國(guo)務(wu)院辦(ban)公廳關于促進(jin)建筑業(ye)持續健康(kang)發展(zhan)的意(yi)(yi)見(jian)》(國(guo)辦(ban)發〔2017〕19號),進(jin)一步(bu)深化建筑業(ye)“放管服”改(gai)革,加快產業(ye)轉(zhuan)型升級,促進(jin)全(quan)省(sheng)(sheng)建筑業(ye)持續健康(kang)發展(zhan),經省(sheng)(sheng)政(zheng)府同意(yi)(yi),現提(ti)出以下實(shi)施意(yi)(yi)見(jian):

一、總體要求和(he)發展目標

牢(lao)固樹立創新(xin)、協(xie)調(diao)、綠色、開放、共(gong)享(xiang)的(de)發(fa)(fa)(fa)展理念,圍(wei)繞(rao)提升工(gong)程質量(liang)安全(quan)(quan)水(shui)平(ping)和增(zeng)(zeng)強企業(ye)(ye)(ye)(ye)核心競(jing)爭力,著(zhu)力推(tui)進建筑(zhu)業(ye)(ye)(ye)(ye)供給側結構性改革和“放管服”改革,加大(da)對龍頭企業(ye)(ye)(ye)(ye)的(de)扶持力度(du)(du),積(ji)極支持民營企業(ye)(ye)(ye)(ye)發(fa)(fa)(fa)展,切(qie)實優(you)化市場發(fa)(fa)(fa)展環境,努力實現全(quan)(quan)省(sheng)建筑(zhu)業(ye)(ye)(ye)(ye)追趕超越、持續健(jian)康發(fa)(fa)(fa)展。到2020年(nian),全(quan)(quan)省(sheng)特(te)級企業(ye)(ye)(ye)(ye)總數(shu)跨(kua)入(ru)全(quan)(quan)國前列,新(xin)增(zeng)(zeng)一級資質企業(ye)(ye)(ye)(ye)150家(jia),年(nian)產值超過100億元的(de)企業(ye)(ye)(ye)(ye)10家(jia)以(yi)(yi)上(shang)(shang);實現建筑(zhu)業(ye)(ye)(ye)(ye)增(zeng)(zeng)加值占GDP比重8.5%以(yi)(yi)上(shang)(shang),建筑(zhu)業(ye)(ye)(ye)(ye)外(wai)向度(du)(du)達(da)到40%左右;新(xin)增(zeng)(zeng)省(sheng)級以(yi)(yi)上(shang)(shang)企業(ye)(ye)(ye)(ye)技術(shu)研發(fa)(fa)(fa)中心5個,獲得國家(jia)級工(gong)法(fa)、專(zhuan)利50項以(yi)(yi)上(shang)(shang),新(xin)創魯班(ban)獎(jiang)不低于25項,勞務(wu)用(yong)工(gong)制度(du)(du)改革和裝(zhuang)配式建筑(zhu)發(fa)(fa)(fa)展取得明顯(xian)成效。

二、深(shen)化建筑(zhu)業簡(jian)政放權改革

(一)優化(hua)資(zi)(zi)質資(zi)(zi)格管理。下(xia)放部(bu)分省級(ji)行(xing)政審批(pi)權限(xian)(xian),全面推行(xing)電子(zi)化(hua)審批(pi),試行(xing)建設工程企業和個(ge)人電子(zi)資(zi)(zi)質資(zi)(zi)格證(zheng)(zheng)(zheng)書(shu),簡化(hua)企業資(zi)(zi)質審批(pi)流(liu)程,提(ti)高行(xing)政審批(pi)效率。適當(dang)放寬崗位證(zheng)(zheng)(zheng)書(shu)、執(zhi)(zhi)(zhi)業資(zi)(zi)格考試報(bao)名(ming)條件,精簡注冊認證(zheng)(zheng)(zheng)環節,縮短發(fa)證(zheng)(zheng)(zheng)、認證(zheng)(zheng)(zheng)時限(xian)(xian)。強化(hua)個(ge)人執(zhi)(zhi)(zhi)業資(zi)(zi)格管理,建立個(ge)人執(zhi)(zhi)(zhi)業保險制度,有序發(fa)展個(ge)人執(zhi)(zhi)(zhi)業事務所,加大對執(zhi)(zhi)(zhi)業人員責任追究和處(chu)罰力度,嚴厲打擊(ji)資(zi)(zi)格掛(gua)靠行(xing)為。

(二(er))加(jia)快推進(jin)信(xin)(xin)(xin)用(yong)體系建設。整合完善全省統一的(de)(de)建筑市場誠(cheng)(cheng)信(xin)(xin)(xin)監管(guan)平臺,制(zhi)(zhi)定建筑行業誠(cheng)(cheng)信(xin)(xin)(xin)評(ping)價辦法,實現(xian)企業和人員信(xin)(xin)(xin)息(xi)(xi)、工(gong)程(cheng)建設信(xin)(xin)(xin)息(xi)(xi)、信(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)息(xi)(xi)實時更新(xin),并及時將相關信(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)息(xi)(xi)匯(hui)集至省公共信(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)息(xi)(xi)平臺,實現(xian)建設、工(gong)商、稅務、人社、金融、司法等(deng)各類(lei)信(xin)(xin)(xin)息(xi)(xi)共享互認。推進(jin)市場主(zhu)體信(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)息(xi)(xi)在資質許可(ke)、招(zhao)標(biao)投標(biao)等(deng)環節的(de)(de)應用(yong),實施分類(lei)動態監管(guan)和差別化(hua)管(guan)理,健全誠(cheng)(cheng)信(xin)(xin)(xin)激勵和失信(xin)(xin)(xin)懲戒機制(zhi)(zhi),營造“守信(xin)(xin)(xin)處(chu)處(chu)受益(yi)、失信(xin)(xin)(xin)處(chu)處(chu)受限”的(de)(de)市場環境。

(三(san))完善工(gong)(gong)(gong)程(cheng)招投標(biao)(biao)制度(du)。以國(guo)有(you)投資為主、依法必須招標(biao)(biao)的(de)(de)工(gong)(gong)(gong)程(cheng)建設項目要(yao)(yao)全部納入(ru)全省(sheng)統(tong)一的(de)(de)公共資源交(jiao)易平(ping)臺(tai),全面推進交(jiao)易全過(guo)程(cheng)電(dian)子化,推行(xing)網(wang)上異地評(ping)標(biao)(biao)。對依法通過(guo)競爭性(xing)談判或單一來源方式確定供應商(shang)的(de)(de)政府采購工(gong)(gong)(gong)程(cheng)建設項目,符合(he)相應條(tiao)件(jian)的(de)(de)應當頒發(fa)施(shi)工(gong)(gong)(gong)許可證。非政府投資工(gong)(gong)(gong)程(cheng)由建設單位自主決(jue)定發(fa)包方式。完善工(gong)(gong)(gong)程(cheng)招標(biao)(biao)“限(xian)高保(bao)低”管(guan)(guan)理辦法和中標(biao)(biao)備案制度(du),整合(he)建立全省(sheng)統(tong)一的(de)(de)綜(zong)合(he)評(ping)標(biao)(biao)專(zhuan)家庫。各地要(yao)(yao)結合(he)全省(sheng)公共資源交(jiao)易平(ping)臺(tai)整合(he),配(pei)齊配(pei)強招投標(biao)(biao)監(jian)管(guan)(guan)隊伍(wu),加(jia)強招投標(biao)(biao)全過(guo)程(cheng)監(jian)管(guan)(guan)。

三、改進工程建造組織模式(shi)

(四)推(tui)進建(jian)(jian)(jian)筑產(chan)業(ye)現(xian)代(dai)化(hua)。各地要(yao)研究(jiu)制(zhi)定推(tui)進智能和裝(zhuang)(zhuang)配(pei)(pei)式(shi)建(jian)(jian)(jian)筑發(fa)展的(de)具體(ti)措(cuo)施,合理布局產(chan)業(ye)基(ji)地建(jian)(jian)(jian)設,加強基(ji)礎和關鍵技(ji)術(shu)(shu)、建(jian)(jian)(jian)筑信(xin)息(xi)模型技(ji)術(shu)(shu)(BIM)的(de)研究(jiu)運用(yong),積極培育產(chan)業(ye)化(hua)龍頭(tou)骨干企業(ye),努力實(shi)現(xian)建(jian)(jian)(jian)造(zao)方(fang)式(shi)從傳統到現(xian)代(dai)的(de)跨越(yue)發(fa)展。省(sheng)級相關部門要(yao)加強指(zhi)導,協調解(jie)決裝(zhuang)(zhuang)配(pei)(pei)式(shi)建(jian)(jian)(jian)筑發(fa)展的(de)重大(da)問題。將裝(zhuang)(zhuang)配(pei)(pei)式(shi)建(jian)(jian)(jian)筑項目列為企業(ye)誠信(xin)評(ping)價(jia)加分(fen)范圍,給予(yu)優(you)先承(cheng)攬工(gong)程項目、創優(you)評(ping)獎等政策(ce)激勵。到2020年,重點推(tui)進地區裝(zhuang)(zhuang)配(pei)(pei)式(shi)建(jian)(jian)(jian)筑占新建(jian)(jian)(jian)建(jian)(jian)(jian)筑的(de)比例達(da)(da)到20%以上,2025年全省(sheng)達(da)(da)到30%以上。

(五(wu))大力(li)推行工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)總(zong)(zong)承包(bao)(bao)(bao)(bao)。裝(zhuang)配式建筑和政府投資(zi)工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)原(yuan)則上采(cai)用工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)總(zong)(zong)承包(bao)(bao)(bao)(bao),工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)總(zong)(zong)承包(bao)(bao)(bao)(bao)單位(wei)對質量(liang)安全、進(jin)度控制、成本管理等負總(zong)(zong)責(ze)。除以暫估價形式包(bao)(bao)(bao)(bao)括在工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)總(zong)(zong)承包(bao)(bao)(bao)(bao)范圍內且依法必須(xu)進(jin)行招標(biao)的(de)項目(mu)外,工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)總(zong)(zong)承包(bao)(bao)(bao)(bao)合(he)同涵蓋的(de)全過程(cheng)(cheng)(cheng)(cheng)各專業(ye)業(ye)務,可(ke)由總(zong)(zong)承包(bao)(bao)(bao)(bao)單位(wei)直接發包(bao)(bao)(bao)(bao)。推進(jin)工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)總(zong)(zong)承包(bao)(bao)(bao)(bao)項目(mu)實行分(fen)別計價、分(fen)別核算(suan)、各計其稅(shui)的(de)稅(shui)收征管辦法。開展工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)總(zong)(zong)承包(bao)(bao)(bao)(bao)試點,完善與工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)總(zong)(zong)承包(bao)(bao)(bao)(bao)相適應(ying)的(de)配套管理制度,培育工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)總(zong)(zong)承包(bao)(bao)(bao)(bao)骨(gu)干企業(ye)。

(六)培育(yu)全過(guo)程(cheng)(cheng)(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)詢(xun)。支持(chi)投(tou)資咨(zi)(zi)詢(xun)、勘察、設計、監理、招標(biao)代(dai)理、造(zao)(zao)價(jia)等企業聯合經(jing)營、并購重組,積極培育(yu)一批全過(guo)程(cheng)(cheng)(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)詢(xun)服務(wu)企業。鼓(gu)(gu)勵擁有單項資質的中介服務(wu)機(ji)構積極注冊建(jian)筑師(shi)(shi)、勘察設計師(shi)(shi)、監理工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)師(shi)(shi)、造(zao)(zao)價(jia)工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)師(shi)(shi)等專(zhuan)業人員,開展工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)全過(guo)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)詢(xun)服務(wu)。改革工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)詢(xun)服務(wu)委托方式,政(zheng)府投(tou)資工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)要帶頭推行(xing)全過(guo)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)詢(xun)服務(wu),引導非政(zheng)府投(tou)資工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)委托全過(guo)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)詢(xun)服務(wu),鼓(gu)(gu)勵在民用建(jian)筑項目中發(fa)揮建(jian)筑師(shi)(shi)的主導作(zuo)用。

四、加強工程質量安全管理

(七(qi))強(qiang)(qiang)化質(zhi)(zhi)量(liang)(liang)(liang)(liang)責(ze)(ze)(ze)任(ren)(ren)(ren)落實。全面(mian)落實各(ge)方(fang)(fang)主體(ti)的(de)(de)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)責(ze)(ze)(ze)任(ren)(ren)(ren),強(qiang)(qiang)化建(jian)設單(dan)位(wei)的(de)(de)首要責(ze)(ze)(ze)任(ren)(ren)(ren)和勘察、設計(ji)、施工(gong)(gong)(gong)單(dan)位(wei)的(de)(de)主體(ti)責(ze)(ze)(ze)任(ren)(ren)(ren),實行(xing)“五方(fang)(fang)責(ze)(ze)(ze)任(ren)(ren)(ren)主體(ti)”項目(mu)負(fu)責(ze)(ze)(ze)人(ren)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)終(zhong)身責(ze)(ze)(ze)任(ren)(ren)(ren)追(zhui)究。嚴(yan)格執(zhi)行(xing)《建(jian)筑安裝工(gong)(gong)(gong)程(cheng)(cheng)(cheng)工(gong)(gong)(gong)期定額》,夯(hang)實監理、監測(ce)、施工(gong)(gong)(gong)圖審查等單(dan)位(wei)的(de)(de)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)責(ze)(ze)(ze)任(ren)(ren)(ren),整治規范建(jian)安工(gong)(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)檢(jian)測(ce)市場,規范質(zhi)(zhi)量(liang)(liang)(liang)(liang)檢(jian)測(ce)機(ji)(ji)構行(xing)為。探索建(jian)立工(gong)(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)擔保(bao)(bao)保(bao)(bao)險制度(du)和建(jian)設單(dan)位(wei)對工(gong)(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)問(wen)(wen)題(ti)的(de)(de)先行(xing)處(chu)置(zhi)和賠償(chang)制度(du),充分發(fa)揮市場機(ji)(ji)制對工(gong)(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)的(de)(de)激勵(li)約束作用。嚴(yan)格執(zhi)行(xing)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)竣(jun)工(gong)(gong)(gong)驗收(shou)標(biao)準,堅決(jue)糾(jiu)正竣(jun)工(gong)(gong)(gong)驗收(shou)把關不(bu)嚴(yan)、不(bu)按行(xing)業規范驗收(shou)等突出問(wen)(wen)題(ti),未經竣(jun)工(gong)(gong)(gong)驗收(shou)合格的(de)(de)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)不(bu)得交付使用。房(fang)地產開(kai)發(fa)企業要依法合規經營,嚴(yan)格落實分戶(hu)驗收(shou)制度(du)和工(gong)(gong)(gong)程(cheng)(cheng)(cheng)保(bao)(bao)修期內的(de)(de)質(zhi)(zhi)量(liang)(liang)(liang)(liang)保(bao)(bao)修責(ze)(ze)(ze)任(ren)(ren)(ren)。

(八(ba))推進質量(liang)管理標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)(zhun)化。增加政府(fu)對標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)(zhun)編制(zhi)的投入,加快編制(zhi)適合陜西歷史(shi)文化、時代風貌(mao)的設(she)計(ji)標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)(zhun),積極培育團體標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)(zhun)和企業(ye)標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)(zhun),建立建筑標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)(zhun)信(xin)息共享機制(zhi),形成(cheng)強制(zhi)性標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)(zhun)與其他標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)(zhun)相結合的標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)(zhun)體系。健全全省建設(she)標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)(zhun)專(zhuan)家委員會,為(wei)工(gong)程建設(she)標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)(zhun)化工(gong)作提供技術支(zhi)撐,提高標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)(zhun)編制(zhi)的質量(liang)和水(shui)平。以創(chuang)建文明工(gong)地(di)為(wei)抓(zhua)手,開展標(biao)(biao)準(zhun)(zhun)(zhun)(zhun)(zhun)化示范活動。

(九)加強(qiang)安(an)全(quan)生產管(guan)理。全(quan)面落(luo)實建(jian)(jian)(jian)設工(gong)程參建(jian)(jian)(jian)各方主體的安(an)全(quan)責任(ren),創新建(jian)(jian)(jian)筑施(shi)工(gong)安(an)全(quan)監(jian)(jian)管(guan)模(mo)式(shi),以建(jian)(jian)(jian)筑起(qi)重(zhong)機械、深基(ji)坑、高支模(mo)等為重(zhong)點,深入推進(jin)“六(liu)位一體”的施(shi)工(gong)安(an)全(quan)監(jian)(jian)管(guan)信(xin)息系(xi)統(tong)建(jian)(jian)(jian)設。推行塔吊、施(shi)工(gong)電梯等大型設備和(he)安(an)全(quan)執業人員聯網監(jian)(jian)管(guan),建(jian)(jian)(jian)立全(quan)覆(fu)蓋、多層次、經常性(xing)的安(an)全(quan)生產培訓制度(du),完(wan)善(shan)建(jian)(jian)(jian)筑施(shi)工(gong)安(an)全(quan)監(jian)(jian)督層級考核制度(du)。健全(quan)質(zhi)量安(an)全(quan)“黑名單”制度(du),強(qiang)化質(zhi)量安(an)全(quan)信(xin)用(yong)懲戒。

(十)提升(sheng)監(jian)(jian)(jian)管(guan)(guan)水(shui)平(ping)。全(quan)(quan)面(mian)落實工(gong)(gong)程(cheng)項目關鍵(jian)崗位(wei)人員實名制管(guan)(guan)理(li),強(qiang)化政(zheng)府對涉及公共安全(quan)(quan)的(de)(de)工(gong)(gong)程(cheng)地基基礎、主體結構(gou)關鍵(jian)部位(wei)和工(gong)(gong)程(cheng)竣工(gong)(gong)等環節的(de)(de)監(jian)(jian)(jian)督(du)檢(jian)查,完善監(jian)(jian)(jian)理(li)單位(wei)向監(jian)(jian)(jian)督(du)機構(gou)定期報告工(gong)(gong)程(cheng)質量情況的(de)(de)制度,落實相(xiang)關職(zhi)能部門的(de)(de)監(jian)(jian)(jian)管(guan)(guan)責任。各(ge)地要加強(qiang)工(gong)(gong)程(cheng)質量安全(quan)(quan)監(jian)(jian)(jian)督(du)隊伍建設,監(jian)(jian)(jian)督(du)機構(gou)履(lv)行職(zhi)能所需經費由(you)同級財政(zheng)預算全(quan)(quan)額保(bao)障(zhang)。監(jian)(jian)(jian)管(guan)(guan)力量不足的(de)(de),可采(cai)取(qu)政(zheng)府購買服(fu)務的(de)(de)方式,委托具備條件的(de)(de)社會(hui)力量進行工(gong)(gong)程(cheng)質量安全(quan)(quan)監(jian)(jian)(jian)督(du)檢(jian)查。

五、優(you)化建筑市場環(huan)境(jing)

(十一)建(jian)(jian)立(li)開(kai)放(fang)有序的市(shi)場。嚴格(ge)落實(shi)推動建(jian)(jian)筑市(shi)場統(tong)一開(kai)放(fang)的有關規定,對省建(jian)(jian)筑市(shi)場誠信監(jian)管平臺可查詢(xun)的省內外建(jian)(jian)筑業(ye)企業(ye),各(ge)(ge)市(shi)(區(qu))、縣不得變相設(she)(she)立(li)審批、備案等準入條件。各(ge)(ge)級住房城鄉(xiang)建(jian)(jian)設(she)(she)、交通運輸、水利等職能部門要(yao)結(jie)合日常業(ye)務辦理(li)和市(shi)場監(jian)管,及(ji)時采集各(ge)(ge)類信息(xi),加(jia)大資質動態(tai)考(kao)核和現(xian)場檢查的力度,嚴厲打擊(ji)圍標(biao)串標(biao)、肢解發(fa)包(bao)、轉包(bao)、非法(fa)分(fen)包(bao)、資質資格(ge)掛靠等違法(fa)違規行為,強化市(shi)場清出管理(li)。

(十二)全(quan)面推(tui)行雙向擔(dan)(dan)保(bao)制度(du)。嚴(yan)格執行以銀行保(bao)函(han)或擔(dan)(dan)保(bao)公司保(bao)函(han)等形式的(de)擔(dan)(dan)保(bao)制度(du),工程(cheng)建(jian)設開工前,建(jian)設單位(wei)和承包(bao)單位(wei)要向對方提(ti)供工程(cheng)款支(zhi)付(fu)擔(dan)(dan)保(bao)和履(lv)約(yue)擔(dan)(dan)保(bao),未提(ti)供工程(cheng)款支(zhi)付(fu)擔(dan)(dan)保(bao)的(de)建(jian)設單位(wei)不予辦理施工許可證(zheng),無法提(ti)供履(lv)約(yue)擔(dan)(dan)保(bao)的(de)承包(bao)單位(wei)不得(de)參與投標(biao)。對采用通用技(ji)術和性(xing)能標(biao)準的(de)政府投資工程(cheng)項目,原(yuan)則(ze)上(shang)采用固定總價合同(tong)的(de)“限(xian)高保(bao)低(di)”辦法,承包(bao)單位(wei)要按照招標(biao)最(zui)高限(xian)價提(ti)供履(lv)約(yue)擔(dan)(dan)保(bao),防(fang)止惡意低(di)價中標(biao)。

(十三)從嚴規(gui)范工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)價款(kuan)(kuan)結(jie)算(suan)。完善工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)量清(qing)單(dan)(dan)計(ji)(ji)價體系和工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)造(zao)價信息發布機制,形成統一的(de)工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)造(zao)價計(ji)(ji)價規(gui)則(ze),合(he)理確(que)定和有效(xiao)控(kong)制工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)造(zao)價。審(shen)計(ji)(ji)部門(men)應(ying)當(dang)依(yi)法加強對以(yi)政府投資為主(zhu)的(de)公共建(jian)設(she)(she)(she)項目(mu)(mu)的(de)審(shen)計(ji)(ji)督導(dao),建(jian)設(she)(she)(she)單(dan)(dan)位(wei)不得(de)以(yi)未完成審(shen)計(ji)(ji)作為延期工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)結(jie)算(suan)、拖欠工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)款(kuan)(kuan)的(de)理由。未完成竣(jun)工(gong)(gong)結(jie)算(suan)的(de)項目(mu)(mu),不得(de)辦理產權(quan)登記。對有拖欠工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)款(kuan)(kuan)的(de)單(dan)(dan)位(wei)不得(de)批(pi)準新項目(mu)(mu)開(kai)工(gong)(gong)。嚴格(ge)執行預(yu)付(fu)款(kuan)(kuan)制度,建(jian)設(she)(she)(she)單(dan)(dan)位(wei)在(zai)合(he)同(tong)簽訂后、正式開(kai)工(gong)(gong)前(qian),應(ying)當(dang)向承(cheng)包單(dan)(dan)位(wei)支付(fu)不低于合(he)同(tong)總額 10%的(de)預(yu)付(fu)款(kuan)(kuan),重大工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)項目(mu)(mu)要(yao)根(gen)據工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)進度按期預(yu)付(fu)。

(十四)下(xia)大力減輕企業(ye)負(fu)擔。嚴(yan)格執行(xing)(xing)中省(sheng)有關建設工程領域保(bao)證(zheng)金(jin)的(de)規定要求,不(bu)得擅自設立法定之外的(de)其他(ta)(ta)保(bao)證(zheng)金(jin),任何單位(wei)不(bu)得拒收(shou)建筑(zhu)業(ye)企業(ye)提供(gong)的(de)銀行(xing)(xing)保(bao)函或(huo)擔保(bao)公(gong)司(si)保(bao)函。工程項目竣工前,已繳(jiao)納(na)履約保(bao)證(zheng)金(jin)或(huo)采用工程質量(liang)擔保(bao)、保(bao)險等其他(ta)(ta)保(bao)證(zheng)方(fang)式(shi)的(de),發包人不(bu)得再預留工程質量(liang)保(bao)證(zheng)金(jin)。嚴(yan)格規范各類涉(she)企收(shou)費,大力推進(jin)政府投資工程欠款(kuan)的(de)清(qing)理償(chang)還工作(zuo),堅決制(zhi)止發生新(xin)的(de)拖(tuo)欠,切實(shi)保(bao)護(hu)承包企業(ye)根本利益。

六、提高(gao)從業人員(yuan)素(su)質

(十五)加大建(jian)(jian)(jian)筑(zhu)(zhu)人(ren)(ren)才(cai)(cai)培養力度。發揮政(zheng)(zheng)府主導作(zuo)用,通過政(zheng)(zheng)策優惠、財政(zheng)(zheng)補貼等方式,加強建(jian)(jian)(jian)筑(zhu)(zhu)行業(ye)(ye)(ye)高端人(ren)(ren)才(cai)(cai)、產業(ye)(ye)(ye)化(hua)人(ren)(ren)才(cai)(cai)和(he)(he)復合型人(ren)(ren)才(cai)(cai)的培養與引(yin)進(jin)。做(zuo)好建(jian)(jian)(jian)筑(zhu)(zhu)工人(ren)(ren)崗前培訓工作(zuo),特(te)級企業(ye)(ye)(ye)、具備條件的一(yi)級總承(cheng)包企業(ye)(ye)(ye)和(he)(he)社會機構可(ke)組(zu)織開(kai)展(zhan)建(jian)(jian)(jian)筑(zhu)(zhu)工人(ren)(ren)職業(ye)(ye)(ye)技能培訓與鑒定。完善(shan)注冊執業(ye)(ye)(ye)人(ren)(ren)員資格(ge)考試辦法,突出實踐能力和(he)(he)專(zhuan)業(ye)(ye)(ye)知(zhi)識考核,對長期從事工程(cheng)技術(shu)(shu)、管(guan)理的人(ren)(ren)員減免考試科目。大力弘揚工匠精神,探索建(jian)(jian)(jian)立獲得重(zhong)大表(biao)彰項目負責(ze)人(ren)(ren)破格(ge)參(can)評(ping)專(zhuan)業(ye)(ye)(ye)技術(shu)(shu)職稱制度,組(zu)織開(kai)展(zhan)建(jian)(jian)(jian)筑(zhu)(zhu)工匠技能大賽(sai),評(ping)選(xuan) “三秦魯班大師”。

(十六)推進勞(lao)務用(yong)(yong)(yong)工(gong)(gong)制度改革。改革建(jian)(jian)筑用(yong)(yong)(yong)工(gong)(gong)方(fang)式,在省內取消(xiao)勞(lao)務資質,建(jian)(jian)立以施工(gong)(gong)總(zong)承(cheng)包企(qi)業(ye)自有工(gong)(gong)人(ren)為(wei)骨干、專(zhuan)(zhuan)業(ye)承(cheng)包和專(zhuan)(zhuan)業(ye)作業(ye)企(qi)業(ye)自有工(gong)(gong)人(ren)為(wei)主體、勞(lao)務派遣為(wei)補(bu)充的多元(yuan)化(hua)(hua)用(yong)(yong)(yong)工(gong)(gong)方(fang)式。鼓勵施工(gong)(gong)企(qi)業(ye)將(jiang)部分技能(neng)(neng)水平高的農民(min)工(gong)(gong)轉化(hua)(hua)為(wei)自有工(gong)(gong)人(ren),引導有一定(ding)管(guan)理能(neng)(neng)力的班組(zu)長組(zu)建(jian)(jian)小微(wei)專(zhuan)(zhuan)業(ye)作業(ye)企(qi)業(ye),享受政府稅收減免政策,穩定(ding)和擴(kuo)大農民(min)工(gong)(gong)在建(jian)(jian)筑行業(ye)就業(ye)創(chuang)業(ye)。推行企(qi)業(ye)用(yong)(yong)(yong)工(gong)(gong)實(shi)名制管(guan)理,加快推進建(jian)(jian)筑用(yong)(yong)(yong)工(gong)(gong)信息管(guan)理平臺建(jian)(jian)設,實(shi)現建(jian)(jian)筑工(gong)(gong)人(ren)身份信息、培訓情況、職(zhi)業(ye)技能(neng)(neng)、從業(ye)記(ji)錄、工(gong)(gong)資支付、誠信記(ji)錄及(ji)用(yong)(yong)(yong)工(gong)(gong)信息等互聯共(gong)享。

(十(shi)七)切實維護工人(ren)合法權(quan)益。全(quan)面實施勞動合同制度(du),用工單位(wei)要與建(jian)筑(zhu)(zhu)(zhu)工人(ren)特別是農民(min)工依法簽訂(ding)勞動合同。用工單位(wei)要將(jiang)返還的(de)勞保(bao)統籌費專項用于建(jian)筑(zhu)(zhu)(zhu)工人(ren)社(she)保(bao)繳(jiao)(jiao)納,企業或個人(ren)繳(jiao)(jiao)納的(de)建(jian)筑(zhu)(zhu)(zhu)工人(ren)城(cheng)鎮職工社(she)保(bao)和城(cheng)鄉(xiang)居民(min)社(she)保(bao),在資質(zhi)許可中予(yu)以認可。實行建(jian)筑(zhu)(zhu)(zhu)工人(ren)工資月清月結制度(du),按照“誰用工、誰負責(ze)”和“總承(cheng)包負總責(ze)”的(de)原(yuan)則落實工資支付和監(jian)督責(ze)任,為建(jian)筑(zhu)(zhu)(zhu)工人(ren)工作、生活提供可靠保(bao)障(zhang)。將(jiang)有(you)拖欠工資行為的(de)企業和法人(ren)列入(ru)黑(hei)名(ming)單,給予(yu)限制市場準入(ru)等懲戒措施。

七、增強企業核心(xin)競爭力

(十(shi)八)大(da)力(li)扶持培育龍頭企(qi)(qi)(qi)(qi)業(ye)。加(jia)大(da)對龍頭骨(gu)干(gan)企(qi)(qi)(qi)(qi)業(ye)的扶持力(li)度,鼓勵企(qi)(qi)(qi)(qi)業(ye)之間兼(jian)并重組(zu),培育指導龍頭企(qi)(qi)(qi)(qi)業(ye)上市(shi),大(da)型(xing)骨(gu)干(gan)企(qi)(qi)(qi)(qi)業(ye)升級(ji)(ji)、增項(xiang)(xiang)和分(fen)立、成(cheng)立子公司時在資質等方(fang)面予以重點扶持。對建筑業(ye)企(qi)(qi)(qi)(qi)業(ye)入庫產值(zhi)較(jiao)上年(nian)增幅超過本地(di)當(dang)年(nian)GDP增速的,應當(dang)全面落實各項(xiang)(xiang)稅收(shou)優(you)(you)惠(hui)政策(ce),支持企(qi)(qi)(qi)(qi)業(ye)發展。相關部(bu)門(men)要(yao)(yao)對重點扶持企(qi)(qi)(qi)(qi)業(ye)在建立技(ji)術中心、申(shen)請工(gong)法、專利及國家、省(sheng)級(ji)(ji)獎(jiang)項(xiang)(xiang)等方(fang)面優(you)(you)先受理(li)和推薦,支持企(qi)(qi)(qi)(qi)業(ye)增強(qiang)科技(ji)創(chuang)新能力(li),提升自主品牌效應。對獲得國家、省(sheng)市(shi)優(you)(you)質工(gong)程和標準(zhun)化管理(li)示范工(gong)地(di)、晉升特級(ji)(ji)和一級(ji)(ji)總承包資質的,各地(di)要(yao)(yao)制定(ding)相應獎(jiang)勵辦(ban)法,激發企(qi)(qi)(qi)(qi)業(ye)爭先創(chuang)優(you)(you)的積(ji)極性。

(十九)積(ji)極支持民(min)營企(qi)業(ye)(ye)(ye)(ye)(ye)發展(zhan)。出臺(tai)支持貧困縣建筑業(ye)(ye)(ye)(ye)(ye)發展(zhan)扶持政策(ce),引導大型(xing)龍頭(tou)企(qi)業(ye)(ye)(ye)(ye)(ye)與貧困縣民(min)營建筑企(qi)業(ye)(ye)(ye)(ye)(ye)開展(zhan)一對一幫(bang)扶,“以大帶小”共同發展(zhan),吸(xi)引當地農民(min)工(gong)就業(ye)(ye)(ye)(ye)(ye)。有(you)序推進國有(you)和(he)集體建筑企(qi)業(ye)(ye)(ye)(ye)(ye)混(hun)合所有(you)制改革(ge),原企(qi)業(ye)(ye)(ye)(ye)(ye)在職(zhi)職(zhi)工(gong)自(zi)愿離(li)職(zhi)的(de)(de),通過建筑行(xing)業(ye)(ye)(ye)(ye)(ye)勞保(bao)統籌費用一次性(xing)補償解決職(zhi)工(gong)社(she)保(bao)問(wen)題。信用好、實力強的(de)(de)優勢民(min)營企(qi)業(ye)(ye)(ye)(ye)(ye)享受與龍頭(tou)骨干企(qi)業(ye)(ye)(ye)(ye)(ye)的(de)(de)同等(deng)扶持政策(ce)。財政、住房城鄉建設、金融(rong)(rong)等(deng)部門要創新投融(rong)(rong)資方(fang)式(shi),積(ji)極搭建優勢民(min)營企(qi)業(ye)(ye)(ye)(ye)(ye)與金融(rong)(rong)機構、龍頭(tou)企(qi)業(ye)(ye)(ye)(ye)(ye)合作的(de)(de)平臺(tai),切實幫(bang)助民(min)營企(qi)業(ye)(ye)(ye)(ye)(ye)破解投融(rong)(rong)資渠道不暢、拓(tuo)展(zhan)市場能力不足的(de)(de)問(wen)題。

(二十)支持(chi)發展(zhan)建筑(zhu)業(ye)總部經濟(ji)(ji)。各地要制定引(yin)(yin)導(dao)(dao)扶(fu)持(chi)政策,吸(xi)引(yin)(yin)央企(qi)、省(sheng)內外(wai)大型優勢(shi)(shi)企(qi)業(ye)在行政區域(yu)內設立(li)(li)總部或成立(li)(li)子(zi)公司,優先保障企(qi)業(ye)落戶(hu)(hu)所需(xu)的(de)生產生活用(yong)地。央企(qi)或外(wai)省(sheng)大型骨干企(qi)業(ye)在陜落戶(hu)(hu)的(de),參照(zhao)我省(sheng)優勢(shi)(shi)企(qi)業(ye)給予重點(dian)扶(fu)持(chi)。有條件(jian)的(de)地方(fang)可(ke)建立(li)(li)具有區域(yu)特色的(de)建筑(zhu)產業(ye)園區,整合裝備(bei)制造、建材生產、設計咨詢、資金物流(liu)等要素,引(yin)(yin)導(dao)(dao)建筑(zhu)業(ye)企(qi)業(ye)集聚發展(zhan),努力形成當地經濟(ji)(ji)新的(de)增長極。

(二十(shi)一(yi))鼓勵企(qi)(qi)業(ye)(ye)(ye)(ye)“走出去”發展。結(jie)合國家“一(yi)帶一(yi)路”戰略規(gui)劃(hua)和區域發展規(gui)劃(hua),加(jia)(jia)大(da)對(dui)(dui)我省建筑企(qi)(qi)業(ye)(ye)(ye)(ye)拓展境(jing)(jing)外(wai)(wai)(wai)市場的(de)支(zhi)持(chi)力度(du),給予企(qi)(qi)業(ye)(ye)(ye)(ye)承接境(jing)(jing)外(wai)(wai)(wai)工(gong)程項目前期費用補助、貸(dai)款貼息、對(dui)(dui)外(wai)(wai)(wai)投資(zi)(zi)合作(zuo)保險費補助、境(jing)(jing)外(wai)(wai)(wai)安全保障(zhang)費用補助、保函費用等(deng)方面的(de)扶持(chi)。金(jin)融機構要積(ji)極支(zhi)持(chi)我省企(qi)(qi)業(ye)(ye)(ye)(ye)對(dui)(dui)外(wai)(wai)(wai)承包業(ye)(ye)(ye)(ye)務,加(jia)(jia)大(da)建筑企(qi)(qi)業(ye)(ye)(ye)(ye)境(jing)(jing)外(wai)(wai)(wai)承接工(gong)程業(ye)(ye)(ye)(ye)務政策性信用保險的(de)支(zhi)持(chi)力度(du),降低企(qi)(qi)業(ye)(ye)(ye)(ye)收匯和融資(zi)(zi)風險。通過舉辦(ban)銀企(qi)(qi)合作(zuo)對(dui)(dui)接會、對(dui)(dui)外(wai)(wai)(wai)企(qi)(qi)業(ye)(ye)(ye)(ye)推介會等(deng)形式,加(jia)(jia)大(da)統籌推進力度(du),跟蹤解決(jue)企(qi)(qi)業(ye)(ye)(ye)(ye)在省境(jing)(jing)外(wai)(wai)(wai)承包工(gong)程過程中遇到(dao)的(de)困(kun)難,營(ying)造(zao)良好的(de)外(wai)(wai)(wai)部市場環境(jing)(jing)。

全省各級政(zheng)(zheng)(zheng)府要(yao)(yao)高(gao)度重(zhong)視建(jian)(jian)(jian)筑(zhu)業(ye)(ye)(ye)“放(fang)管服”改(gai)革(ge)(ge)(ge)工(gong)作(zuo),充分認清加(jia)快建(jian)(jian)(jian)筑(zhu)業(ye)(ye)(ye)改(gai)革(ge)(ge)(ge)發(fa)展(zhan)對于吸納和轉移農(nong)村富余(yu)勞動(dong)力(li)、拉動(dong)相關產(chan)業(ye)(ye)(ye)發(fa)展(zhan)、推(tui)(tui)(tui)動(dong)新型城鎮化進(jin)(jin)程(cheng)、促進(jin)(jin)經濟平穩較(jiao)快增長(chang)的(de)重(zhong)要(yao)(yao)意義,進(jin)(jin)一步增強責任感(gan)和緊迫感(gan)。省級相關部門要(yao)(yao)加(jia)大指導(dao)、協調和支(zhi)持(chi)力(li)度,積極(ji)破解制約(yue)建(jian)(jian)(jian)筑(zhu)業(ye)(ye)(ye)改(gai)革(ge)(ge)(ge)發(fa)展(zhan)的(de)“瓶(ping)頸”問題。各市、縣政(zheng)(zheng)(zheng)府要(yao)(yao)切實把推(tui)(tui)(tui)進(jin)(jin)建(jian)(jian)(jian)筑(zhu)業(ye)(ye)(ye)改(gai)革(ge)(ge)(ge)發(fa)展(zhan)工(gong)作(zuo)擺上重(zhong)要(yao)(yao)議事日程(cheng),緊抓當前擴大內需機遇(yu),采取有力(li)的(de)措施(shi)(shi)積極(ji)推(tui)(tui)(tui)進(jin)(jin),加(jia)大政(zheng)(zheng)(zheng)策(ce)(ce)扶持(chi)力(li)度,不斷推(tui)(tui)(tui)進(jin)(jin)建(jian)(jian)(jian)筑(zhu)業(ye)(ye)(ye)持(chi)續健康發(fa)展(zhan)。相關行業(ye)(ye)(ye)協會要(yao)(yao)及時反映企(qi)業(ye)(ye)(ye)訴求,反饋政(zheng)(zheng)(zheng)策(ce)(ce)落實情況,發(fa)揮(hui)好規(gui)范行業(ye)(ye)(ye)秩(zhi)序、建(jian)(jian)(jian)立從業(ye)(ye)(ye)人員行業(ye)(ye)(ye)準則、促進(jin)(jin)企(qi)業(ye)(ye)(ye)誠(cheng)信經營等方(fang)面的(de)自律作(zuo)用(yong)。本實施(shi)(shi)意見下發(fa)之日起30個工(gong)作(zuo)日內,各市(區)、省直管縣要(yao)(yao)將推(tui)(tui)(tui)進(jin)(jin)建(jian)(jian)(jian)筑(zhu)業(ye)(ye)(ye)改(gai)革(ge)(ge)(ge)發(fa)展(zhan)的(de)具體(ti)措施(shi)(shi)書面報(bao)省政(zheng)(zheng)(zheng)府辦公廳,并(bing)抄(chao)送(song)省住房(fang)城鄉(xiang)建(jian)(jian)(jian)設廳。
